Terms of service
These terms govern access to and use of The Food Please platform (thefoodplease.com and the *.thefoodplease.com subdomains), owned by [RAZÓN SOCIAL / COMPANY NAME], tax ID (NIF) B87266987, registered office at [DIRECCIÓN / ADDRESS], e-mail [email protected] (“The Food Please”, “we”). By creating an account, the restaurant or hospitality business (the “Customer”) accepts these terms, the Privacy policy and the Data processing agreement in full.
1. The service
The Food Please is a cloud service (SaaS) for hospitality businesses that includes, depending on the plan and modules purchased:
- Digital menu: a menu reached by QR code or NFC on the Customer's own subdomain, with photos, allergens, languages and daily specials.
- Orders: table and pick-up orders, kitchen screen, notifications and in-app payments.
- Reviews: collecting ratings from the venue's guests and linking to its Google listing.
- Time clock: recording the working hours of the Customer's employees.
- Rental: managing bookings and rental of spaces or equipment.
- Reservations, customer club, stamps and The Market (buying from suppliers), when active on the account.
The service is improved continuously. We may add, change or withdraw non-essential features; where a change affects everyday use we will give reasonable notice.
The service is intended exclusively for professionals and businesses (B2B). The Customer declares that it acts within its business activity and not as a consumer.
2. Sign-up, account and free trial
To use the service you must create an account through the sign-up wizard, giving the venue name, subdomain, contact details and an administrator. Details must be accurate and kept up to date.
Sign-up opens a free 7-day trial with every feature of the chosen plan. Nothing is charged during the trial. If no payment method has been added when it ends, or the Customer cancels earlier, the account is suspended and may be deleted after 30 days.
The Customer is responsible for keeping its credentials safe and for everything done with its account, and must tell us without delay of any unauthorised use.
We may refuse or cancel sign-ups that breach these terms, use third-party names or trademarks, or abuse the free trial.
3. Price, billing and payment
The base “Digital menu” plan costs €29.90 per month, VAT not included. Add-on modules and higher plans (orders, payments, reservations, customer club, stamps, reviews, time clock, rental…) are priced as published at any time on thefoodplease.com and in the Customer's dashboard. Published prices exclude VAT and any other applicable taxes, which are added to the invoice.
Payment is made by card through Stripe, which processes charges and stores card data. The Food Please does not store card numbers.
The subscription is monthly and renews automatically for one-month periods until cancelled. Each period is charged in advance. Yearly options, where offered, are charged in advance for the full period.
The Customer may cancel at any time, in one click, from the dashboard (Modules or Billing) or from the Stripe billing portal. Cancellation takes effect at the end of the period already paid; ongoing periods are not prorated or refunded, except under the 30-day guarantee.
30-day guarantee: if the Customer is not satisfied, it may request a full refund of the first payment by writing to [email protected] within 30 days of the first charge. Refunds go to the original payment method.
We may change prices with at least 30 days' notice by e-mail; the new price applies from the next renewal. If the Customer disagrees it may cancel before that date.
Invoices are issued electronically and are available in the dashboard and billing portal. The tax details shown are those entered by the Customer, who is responsible for keeping them correct.
4. Non-payment and suspension
If a charge fails we will retry it and notify the Customer by e-mail. After 7 days without payment we may suspend access to the dashboard and the public menu, which will show a temporary notice. Suspension does not waive amounts due.
Once payment is settled the service is reactivated immediately. If non-payment exceeds 60 days we may terminate the contract and delete the account and its data, after notice, in accordance with the Privacy policy.
5. Customer obligations
Menu content. The Customer is solely responsible for the content it publishes: names, descriptions, photos, prices, allergens and availability, and warrants that it holds the rights to the texts, images and trademarks it uploads.
Allergens. The Customer must declare substances causing allergies or intolerances in accordance with Regulation (EU) 1169/2011 and Spanish Royal Decree 126/2015, and keep that information accurate and up to date in the digital menu. The Food Please provides the tools to declare them but does not verify their accuracy and is not liable for the Customer's errors or omissions.
Prices. Prices shown to the public must be complete, include VAT and match those charged at the venue. The Customer answers to its guests for any discrepancy.
Orders and payments. The Customer sells and delivers the products; The Food Please only provides the tool. In-app payments are made into the Customer's Stripe account (Stripe Connect), subject to Stripe's terms. Refunds, complaints, receipts and consumer invoices are the Customer's responsibility.
Reviews. The Customer undertakes to use the reviews module fairly, in line with Google's policies and consumer law, which prohibits fake reviews and incentives that condition the content of a review. The thank-you line and any incentive are the Customer's decision and responsibility.
Time clock. As employer, the Customer is responsible for its employees' working-time records (art. 34.9 of the Spanish Workers' Statute), for informing them and for keeping the records. Processing of that data is governed by the Data processing agreement.
Lawful use. Using the service for unlawful purposes, sending unsolicited communications, introducing malicious software, attempting to access other customers' data or deliberately overloading the platform is prohibited.
6. Personal data
Processing of the Customer's and its users' personal data is described in the Privacy policy. For data of the restaurant's own guests (orders, reservations, club, reviews) and employees (time clock), the Customer is the controller and The Food Please acts as processor under the Data processing agreement, which forms part of these terms.
7. Intellectual property
The platform, its software, design, trademarks (The Food Please) and documentation belong to [RAZÓN SOCIAL / COMPANY NAME] or its licensors. The Customer receives a non-exclusive, non-transferable licence limited to the term of the subscription.
The Customer keeps all rights to the content it uploads (texts, photos, logo, brand) and grants The Food Please a non-exclusive, royalty-free, worldwide licence to host, reproduce, adapt (e.g. resize images or translate texts) and display it for the sole purpose of providing the service, for the term of the subscription.
Unless the plan purchased allows it to be turned off, the public menu discreetly shows “The Food Please” as the platform. We may cite the Customer's name and logo as a commercial reference unless it objects in writing.
8. Availability and support
We work to keep the service continuously available but do not guarantee 100 % uptime. Interruptions may occur for maintenance (which we will try to schedule at quiet hours and announce), technical reasons or third parties (hosting, networks, Stripe, Google).
We back up the platform regularly. We nevertheless recommend that the Customer export or keep a copy of its important information (menu, reports, working-time records).

9. Limitation of liability
To the extent permitted by law, The Food Please is not liable for indirect damages, loss of profit, business, data or reputation arising from use of or inability to use the service, nor for content published by the Customer, nor for the acts of third parties (Stripe, Google, Market suppliers, telecom operators).
The Food Please's total liability to the Customer, on any ground, is limited to the amount paid by the Customer in the 12 months preceding the event giving rise to it.
Nothing above limits liability for wilful misconduct or gross negligence, or any liability that cannot legally be excluded.
10. Term and termination
The contract starts at sign-up and lasts while the subscription is active. The Customer may cancel at any time (clause 3). We may terminate for serious breach, non-payment (clause 4) or unlawful use, with notice where possible.
On termination the public menu and dashboard become unavailable. The Customer may request an export of its data within the following 30 days; the data is then deleted in accordance with the Privacy policy and the Data processing agreement.
11. Changes
We may update these terms. Material changes are communicated by e-mail or in the dashboard at least 15 days in advance. Continued use after that date means acceptance; if the Customer disagrees it may cancel at no cost before they take effect.
12. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute is submitted to the courts of [CIUDAD DEL DOMICILIO SOCIAL / CITY OF REGISTERED OFFICE], Spain, the parties expressly waiving any other forum, unless the law provides otherwise.
